Marketing compliance

You must not submit purchased, harvested, scraped, rented, or third-party email addresses into NitWings forms. If you ask NitWings to review or support your email program, you remain responsible for lawful consent, unsubscribe handling, suppression, sender identification, privacy compliance, and applicable email marketing obligations.

Services

NitWings provides consulting, implementation, advisory, training, monitoring, incident support, and technical guidance for email deliverability, DNS, authentication, email infrastructure, Linux, cloud, and DevOps operations. Specific commercial terms, scope, pricing, access, timelines, and deliverables may be agreed separately in proposals, statements of work, or other commercial documents.

No guaranteed outcomes

Deliverability and infrastructure outcomes depend on sender behavior, list quality, mailbox provider rules, reputation, authentication, DNS, content, recipient engagement, infrastructure conditions, and third-party systems. NitWings provides expert review, advice, and implementation support, but does not guarantee inbox placement, provider approval, revenue, uptime, acceptance, ranking, or any specific technical or commercial result.

Client responsibilities

Clients are responsible for accurate information, lawful sending practices, valid consent, clean data, appropriate approvals, timely access, backups, change management, review of recommendations, and compliance with applicable privacy, security, anti-spam, advertising, and industry requirements.

Technical access and shared data

If you provide DNS access, system access, platform credentials, headers, logs, campaign data, account screenshots, or infrastructure details, you confirm that you are authorized to share them. NitWings may use that information for the requested work and related recordkeeping.

Intellectual property

The website and its original content, branding, structure, graphics, text, and features remain the property of NitWings and its licensors or respective owners. You may link to public content, but you may not copy, reproduce, resell, republish, or present NitWings materials as your own without permission.

Third-party websites and platforms

The website may link to third-party sites or services. Email service providers, mailbox providers, cloud vendors, analytics tools, ad networks, blocklists, DNS providers, and other external services operate under their own terms and policies. NitWings is not responsible for third-party content, policy changes, outages, enforcement actions, service failures, or business decisions.

Disclaimer

The website and public content are provided on an 'as is' and 'as available' basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, NitWings is not liable for indirect, incidental, consequential, special, punitive, or loss-of-profit damages arising from website use, reliance on public content, third-party tools, or consulting work.

Termination
